A criminal case opened for possession of high-risk drugs was finally dismissed on 4 September 2026, after Alba Court confirmed the decision of DIICOT Alba Iulia to abandon the criminal investigation, according to alba24.ro.
The man had been detected in the night of 22 June 2025, around 02:25, on a street in Alba Iulia. He was found in possession of 0.80 grams of substance containing 2-MMC, a synthetic drug classified as a high-risk substance. He was investigated for unlawful possession of high-risk drugs for personal consumption.
In August 2026, DIICOT prosecutors decided to abandon the criminal investigation, considering that there was no longer sufficient public interest to continue the inquiry. Among the arguments retained by prosecutors were the reduced quantity of substance, its intended purpose — personal consumption — and the man's cooperative behaviour during the investigation.
An additional factor invoked was proportionality: the resources and costs necessary to continue the criminal proceedings would have been disproportionate to the actual gravity of the offence.
The case prosecutor filed a request to confirm the abandonment of criminal investigation, which the magistrates of Alba Court admitted. The decision is final. The court's reasoning was made public recently.
