Decisive day for Georgescu: three courts, one single day

Monday, 12 October, Călin Georgescu has three separate judicial procedures scheduled, according to Gândul. The former presidential election candidate is to appear at the Bucharest Tribunal, at the DIICOT headquarters and at the Bucharest Court of Appeal — all on the same day.

Request to replace preventive detention

At the Bucharest Tribunal, judges are examining Georgescu's request to replace preventive detention with a milder measure. The Bucharest Court of Appeal had ordered his preventive arrest for 30 days through a decision from 29 September, in the file being investigated by DIICOT in which he is being investigated for fraud.

The investigation concerns an estimated loss of over 1.1 million euros. Georgescu contests the charges, and the court is to determine whether the continuation of the freedom-restricting measure remains justified.

Computing investigations at DIICOT

Also on Monday, Georgescu is to be brought to the DIICOT headquarters, where investigators continue enquiries in the same fraud case. In previous days, both the former candidate and his wife, Cristela Georgescu, were brought to the institution to attend computer searches carried out on devices seized from their home.

Prosecutors are examining mobile phones, computers and other storage media in search of information relevant to the investigation. The enquiries concern, among other things, the tracing of the sums of money that are the subject of the case.

Potra case, hearing at the Court of Appeal

A third hearing is scheduled on Monday at the Bucharest Court of Appeal, in the case in which Georgescu is being tried alongside Horațiu Potra and 20 other defendants for attempted action against constitutional order.

At the previous hearing, on 28 September, the court adjourned the case after defence lawyers requested clarification on the existence of a confidential file, which they claimed would contain documents extracted from the Georgescu-Potra case. The judge ordered further verification and set the new hearing for 12 October.

The case relates to alleged actions aimed at destabilising constitutional order, in the context of events surrounding the annulment of the 2024 presidential elections. Among the defendants is Horațiu Potra, a former member of the Foreign Legion, and persons from his circle.

Three separate cases

Gândul clarifies that the three procedures are independent of one another: the request regarding the preventive measure and the DIICOT investigation belong to the fraud case, while the hearing at the Court of Appeal concerns the case in which Georgescu appears as a defendant alongside Potra and the other accused.
