Scanian woman sentenced for tax crime after million-kronor income from OnlyFans
A woman from Scania has been sentenced to eight months in prison after earning 1.66 million kronor from self-produced pornographic material on the platforms OnlyFans and Myfans without declaring the income. This is reported by Sydsvenskan, which has previously written about the woman.
The sentence covers several crimes: serious tax crime, bookkeeping crime, obstruction of tax inspection, money laundering, and serious libel against her ex-partner.
Millions in kronor – reported income: 168,000 kronor
During 2020 and 2021, the woman drew a total of 1.66 million kronor via the subscription services. In her tax returns, however, she reported a combined income of 168,157 kronor for the two years.
The investigation was initiated after the British companies behind OnlyFans and Myfans sent tax statements to the Swedish Tax Agency. According to the district court, the woman should have paid just over 600,000 kronor in tax on the income.
The woman has a significant following on social media – over 50,000 followers on Snapchat and half a million likes on TikTok. Subscribers to her OnlyFans page received access to nearly 300 posts for a fee of 18 euros per month.
District court rejects employment explanation
During the trial, the woman claimed that she perceived herself as employed by the platforms and therefore believed that the companies handled tax payments and social contributions – because the companies retained 20 per cent of the revenue.
The district court rejects that explanation. The court finds that the 20 per cent constitutes a platform fee, not a tax deduction. The court also notes that the woman herself set the price for her material, had no boss and never had an employment contract – circumstances that contradict her perception that she was employed.
Libel against ex-partner included in the sentence
The prosecutor argued that the woman should also be sentenced for illegal harassment after she accused her ex-partner of child abuse in several posts on social media to her large following.
The district court assesses that only two of four posts constitute serious libel and therefore does not consider that it occurred systematically. The woman is sentenced for the two individual publications, not for illegal harassment. During the trial, she stated that she did not understand that the posts could be illegal.
Money laundering and financial sanctions
The sentence also includes that the woman received 4,000 kronor in her account that originated from car fraud – an incident classified as money laundering.
In addition to the eight-month prison sentence, the woman is ordered to pay a corporate fine of 200,000 kronor and a tax surcharge of 453,000 kronor. To her ex-partner she must pay 30,000 kronor in damages.
The district court finds that the totality of the criminal conduct does not permit any other penalty than imprisonment.
