The eastern Slovak town of Gelnica became the scene of a family tragedy. Tomáš V. killed his own wife just eleven days after the District Court in Spišská Nová Ves released him from custody. The judge gave him a suspended sentence for the fact that in February, while intoxicated, he attacked and threatened her.
After his release, however, the situation turned fatal. The man killed his partner and is now being prosecuted for the serious crime of murder. He is in custody again.
The institution that decided on his sentence has now published the reasons for its decision. It was based on an expert assessment by a psychiatrist. This assessment stated that the accused did not suffer from any mental illness or disorder and his return to society did not endanger those around him. The court also pointed out that with a suspended sentence, a restraining order preventing contact with the victim or electronic monitoring via a bracelet are not normally issued.
The head of police Jana Maškarová also commented on the entire case. At a briefing on Thursday, she announced that in connection with this event she plans legislative changes. She proposes that the law impose an obligation to alert vulnerable persons at the moment when the perpetrator of violence leaves prison. Another innovation could be the possibility of verifying whether aggressive behaviour does not repeat itself in the first hours after the incident, if the opportunity to evict the perpetrator from the home was not used.
Maškarová met with representatives of the ministry of justice as well as the prison and judicial guard. She also ordered an investigation into how police proceeded in the given case. The results should be known on Monday. According to her preliminary findings do not show an error on the part of the authorities. The investigator questioned the victim, the perpetrator was detained within two hours and on the following day they requested his remand in custody. The police only learned of the man's release on the 17th of June when the judgment was delivered.
Minister of Justice Boris Susko on Wednesday suggested that he is prepared to order supervision of court proceedings. He described the act itself as an individual failure of one person.
