The Court of Appeal unanimously upheld the 12-year sentence for Moisés Martínez. His lawyer is preparing a cassation appeal.

Defence of Moisés Martínez to appeal to Supreme Court following unanimous Court of Appeal ruling
The Court of Appeal in Criminal Matters, First Panel, unanimously upheld on Friday the 12-year prison sentence for Moisés Martínez, the 29-year-old who in May 2025 shot his father to death after several years of abuse and mistreatment. According to subrayado.com.uy, the defence is already preparing a cassation appeal to the Supreme Court of Justice.
Lawyer María de la Paz Echetto stated that Martínez is in prison and that the sentence represents "a very hard blow" for him and his family, although she highlighted that he has the support of friends. "There remains the sense that we must bet strongly on prevention and attention to situations of gender-based violence and violence against children," Echetto said, and added that the court itself acknowledged that Carlos Martínez "was a domestic tyrant who exposed the family nucleus to situations of violence and abuse that could be characterised as torture".
The origin of the sentence dates back to 8 April, when criminal judge María Noel Odriozola imposed the sentence for especially aggravated homicide. The case is being handled by the First Panel Homicide prosecutor, Sabrina Flores.
In response to that ruling, defence lawyers Rodrigo Rey and María de la Paz Echetto filed an appeal. The judges Marcelo Malvar, Dolores Sánchez and Graciela Eustachio decided to uphold the original sentence, in a ruling announced in recent hours.
The defence will now seek to reverse the decision through a cassation appeal, the last ordinary instance available in the Uruguayan criminal justice system.
