A former Police Scotland officer who recorded himself raping a sleeping woman has been sentenced to seven years in prison at the High Court in Glasgow, Sky News reports.

Derek McNee, 43, attacked his victim at a property in East Dunbartonshire in 2025. He was identified after police recovered four incriminating videos from his mobile phone showing him performing sexual acts on the woman while she was clearly intoxicated.

McNee had left Police Scotland in 2016 after seven years of service, and had since been running a dog grooming business in Paisley.

Judge David Young KC sentenced McNee following his guilty plea to rape, and ordered him to be monitored for 18 months upon release from prison. McNee was also placed on the sex offenders register and banned indefinitely from contacting or approaching both victims.

Addressing McNee in court, Judge Young said: "As you recognise, there can be no free agreement when someone is incapable to give consent." He added that the woman had described her "misery" at McNee's hands in two victim impact statements, and remained affected by what had happened.

Prosecutor Ruaraidh Ferguson told the court: "Four videos were recovered from his telephone which depict McNee performing sexual acts on the woman while she is clearly and obviously intoxicated. At various stages, she is asleep or unconscious." In one clip, McNee was wearing a mask across his eyes while the woman was described as "fully unresponsive throughout".

The court heard that McNee had previously asked the woman whether he could perform sexual acts on her while she slept. She had agreed, and McNee suggested filming the acts. McNee later sent her the footage, but she told him to delete it.

McNee also pleaded guilty to harassing a second woman between 2021 and 2025 across Glasgow and Paisley. That victim was forced to change her phone number, but McNee obtained it and contacted her almost 30 times within two days. He further admitted possessing a stun gun, found during a search of his car in August 2025.

Defending counsel Tony Graham KC said: "He has accepted his guilt — that is the best thing that can be said in mitigation on his behalf."

McNee had previously been convicted in 2021 at Glasgow Sheriff Court of engaging in abusive conduct towards a young woman, who described seeing "the devil in his eyes." He had assaulted her, threatened to kill her, and destroyed her designer jacket with tweezers, resulting in a supervision order and a curfew.
