The prosecution and the private complainant have requested the maximum sentence of life imprisonment for Hernán Bonda and Elías Fernández, accused of the murder of Sebastián Ochoa, a 26-year-old youth who was shot in the back during a robbery in José C. Paz, according to cadena3.com.
The accused face charges of aggravated homicide caused by crime by means of treachery and premeditated participation of two or more persons. Elizabeth, the victim's mother, confirmed to Agencia Noticias Argentinas that her lawyer, Marcela Durán, and prosecutor Ana María Armetta presented the request for the most severe sentence provided for by law. "They are being accused of the most serious crime there is in our Penal Code," Elizabeth stated, who received the support of families of other victims.
The verdict on 9 September
The sentence will be announced at a virtual hearing on Wednesday, 9 September at 9:30 a.m. at the Criminal Oral Court No. 7 of the Judicial Department of San Martín, based at Lincoln 381.
How the crime occurred
On 19 January 2024, Sebastián left his shift as a petrol pump attendant at a service station and was pursued for nine blocks by four criminals travelling on two stolen motorcycles. The attackers intercepted him and ordered him to abandon his vehicle. Ochoa offered no resistance and handed over the car. Nevertheless, the assailants shot him in the back as he was walking away.
Two fugitives still at large
Only Bonda and Fernández are accused. Ochoa's family demands that justice locate the other two participants in the crime, whose names have not been revealed, although one of them is identified in the case as "Pasi" or "Pasita".
Elizabeth denounced the silence surrounding the case: "Everyone is afraid to testify. They go to the neighbourhood and no one knows him. He has a name and surname in the case, but people don't want to talk." The mother pointed out that fear in the community is obstructing progress in the investigation against the fugitives.
A life cut short
Sebastián Ochoa was 26 years old, worked at a service station, and was the father of a baby one year and eight months old. At the time of the crime, his partner was expecting the birth of their second daughter, whom he would never meet.
