Remand in custody for two defendants in Mercedes Uviedo death in Santa Fe

Two men were remanded in custody in proceedings relating to the homicide of Mercedes Evangelina Uviedo, which occurred on Thursday of last week in the Santa Rosa de Lima neighbourhood of the city of Santa Fe. According to sol915.com.ar, the investigation is being conducted by public prosecutor Estanislao Giavedoni of the Public Prosecution Service (MPA).

The precautionary measure was ordered on Wednesday afternoon by judge Rosana Carrara during a hearing held at the provincial capital courts. The defence lawyers for both defendants did not oppose the prosecution's request.

How the incident occurred

Prosecutor Giavedoni clarified that the incident took place at around 20:30, in the vicinity of Arenales at 2,200. "The woman received a gunshot during a confrontation between her nephew and a neighbour of hers," he stated.

According to the reconstruction presented by the MPA, the conflict began when Uviedo's neighbour, a 31-year-old man identified by the initials PDF, fired a shot into the air to intimidate the victim's nephew and then entered his home.

The nephew, identified as MAU, aged 28, then responded by firing several shots at PDF. "He fired repeatedly in order to kill the other defendant, an objective he failed to achieve because the man managed to enter his home, which is adjacent to that of the deceased woman," Giavedoni recounted.

"However, one of those shots struck his aunt, who at that moment had come out onto the street," the prosecutor emphasised.

The charges

PDF was charged with the offence of aggravated threats through the use of a firearm. MAU, by contrast, was charged with attempted qualified murder through the use of a firearm in relation to PDF, and with the offence of qualified murder through the use of a firearm for the death of his aunt.

Giavedoni explained the basis for this latter charge: "At the moment he fired the shots, he knew or should have known that his conduct could strike any person who was in the so-called 'line of fire', as indeed occurred with his aunt."
