The 15th Criminal Law Chamber of the Court of Justice of São Paulo (TJSP) confirmed, by unanimous vote, the sentence of the Jury Court of the District of Francisco Morato that convicted two brothers of qualified murder and concealment of a corpse. According to portal.tjsp.jus.br, each defendant's sentence was set at 15 years of imprisonment, in an initial closed regime.
According to the case files, the accused organised an ambush against the victim motivated by disagreements in the professional sphere and by the suspicion that the man was harassing the partner of one of them. The victim left home on the way to work and did not return. Images from security cameras recorded the man walking alongside one of the accused in the direction of a railway station.
According to investigations, he was led to the vicinity of a football field, where he was killed. The body was never found.
The defence appealed requesting the annulment of the trial, arguing that the jury's decision was in manifest contradiction with the evidence gathered in the proceedings. The reporting judge on the appeal, Judge Christiano Jorge, rejected the argument. According to the magistrate, the authorship of the crime was widely demonstrated by oral evidence and the accused altered their versions throughout the investigations.
"In the confrontation between evidence favourable to the prosecution and evidence favourable to the defence, the jurors opted for one of the possible interpretations of the events. In short, the jury's decision is in full consonance with the evidence produced in the course of criminal proceedings, making the annulment of the trial impossible as intended by the defence. The conviction of the appellant is therefore maintained," wrote Christiano Jorge.
Judges Conceição Vendeiro and Diniz Fernando completed the judging panel. The appeal proceeded under case number 1503052-23.2020.8.26.0197.
