Minister Flávio Dino of the Supreme Federal Court lifted on Sunday (13) the secrecy from investigations conducted by São Paulo's Civil Police into the producer of the film Dark Horse, as reported by guaiba.com.br. The measure was published in an order and follows a similar decision adopted last week regarding Federal Police documents on the same feature film, which narrates the trajectory of former president Jair Bolsonaro.
Dino justified the lifting of secrecy based on the principle of equality before the law. "All those mentioned in the same proceedings or in parallel proceedings, but in identical situations, must receive the same treatment, from the opening of investigations," stated the minister in the order.
The decision provides for the release of all material from the State Court for Safeguarding Criminal Organisations and Money Laundering, Assets, Rights and Values of the Central Criminal Court Barra Funda, of the District of São Paulo. Dino exemplified that, if "bank owners, politicians or judges appear as suspects in a set of proceedings, all investigations must proceed congruently, with full publicity — names, financial data, accounts and funds moved, WhatsApp conversations, among other evidence".
In the same order, the minister pointed out that the investigations reinforce the hypothesis of "inseparable intertwining in a sophisticated scheme for channelling and diverting public funds, with emphasis on federal parliamentary amendments and São Paulo city hall". Dino added that the organisation under investigation would have "links with the PCC faction (First Command of the Capital)" and mentioned, "in the hypothetical realm of the investigation", federal deputy Mário Frias as a figure with supposed leadership role in the criminal architecture pointed out in the proceedings.
The investigations into Dark Horse proceed on different fronts. Among the elements being investigated are transfers of R$ 62.8 million attributed to entrepreneur Vorcaro for financing the film, at the request of senator Flávio Bolsonaro, pre-candidate for the presidency of the Republic.
