The Jury Court of Paulo Ramos District in Maranhão acquitted two defendants in sessions held on 29 and 30 September, as reported by g1.globo.com. The trials dealt with distinct cases: an attempted homicide that occurred in 2018 and a homicide recorded in 2024. Both sessions were presided over by judge Vinícius Sales.
Defendant admitted to firing shots but claimed self-defence
In the first trial, Flávio de Oliveira Rodrigues faced charges of attempted homicide against Alom Rodrigues da Silva, which occurred on 16 April 2018. According to the indictment, Flávio fired five shots from a firearm at the victim — three shots missed and two struck Alom.
The conflict between the two is said to have begun months before the crime, following a disagreement related to a mechanical service that was not performed "on credit" by Flávio for Alom, which is said to have generated animosity between them.
During interrogation, Flávio confirmed that he had fired the shots, but maintained that the episode occurred during a physical struggle and that he fired fearing the victim was armed.
Judge Vinícius Sales explained that the Jury Panel voted affirmatively on the generic absolutory issue provided for in the Code of Criminal Procedure. According to the magistrate, this issue encompasses the defence's arguments, including the possibility of self-defence. Since the jury's voting is confidential and based on intimate conviction, it is not for the judge to indicate the specific reason that led to the acquittal.
Second case: stabbing death in bar in rural area
In the following session, Francisco do Nascimento Oliveira, known as "Chicão", faced charges in the death of Josias Silva Araújo, which occurred on 11 September 2024 in the village of Centro dos Leite, rural area of Paulo Ramos.
According to the indictment, Josias was killed by knife wounds inflicted by the defendant. The investigation indicated that Francisco, the victim and other individuals were consuming alcoholic beverages at "Bar do Felipinho" when a dispute began between the two. Witnesses reported that "Chicão" had taken a knife and struck Josias repeatedly. The victim did not survive the injuries.
During the arguments, the Public Ministry maintained the materiality and perpetration of the crime, contested the self-defence argument and presented submissions relating to aggravating factors and recognition of privileged homicide. The defence also sought recognition of privileged homicide and the dismissal of the aggravating factors.
At the end of the session, the Jury Panel likewise decided to acquit Francisco do Nascimento Oliveira.
