Lawyer calls for appointment of private prosecutor in "Mafia State" case

Lawyer Achilleas Dimitriades has called for the immediate appointment of a private prosecutor to be able to direct the investigative work concerning the alleged offences arising from the book "Mafia State" and the report by the Anti-Corruption Authority.

In statements to the Cyprus News Agency, Mr Dimitriades explained that the independent investigative team appointed by the Cabinet constitutes only 50% of the process. The other half, according to him, is the appointment of a private prosecutor who will ensure independence in the assessment of the report and in the drafting of the indictment.

"If an appointment is not made today, the direction of the investigative work will be given by the Legal Service, which by its nature has requested that the Attorney-General and the Deputy Attorney-General be exempted and consequently everyone else. Therefore, if we want this process to be truly independent, not only independent criminal investigators, but also immediately an independent prosecutor to evaluate and direct the investigative work, so that it can be used in criminal proceedings from now on," he said.

Mr Dimitriades added that if they wait until there is a need for the appointment of the prosecutor, a very serious issue is avoided, which is the appointment of an independent prosecutor who is an integral part of the entire process.

When asked who would appoint the prosecutor, the lawyer replied that this could be done by the Attorney-General under the Constitution or the Prosecutorial Council if it had delegated the authority to him.
