The Cyprus Appeal Court has suspended a custodial sentence imposed on a man convicted of robbery and conspiracy, finding that the District Court had not adequately considered his personal circumstances.

The Cyprus Appeal Court has suspended the custodial sentence imposed on a man convicted of robbery and conspiracy to commit a felony, finding that the District Court had not adequately taken into account the personal circumstances of the convicted person.
The appellant had admitted his guilt for robbery involving the use of force, in which 60 euros was taken from the victim, as well as for conspiracy related to drug trafficking. The Assizes Court had imposed a sentence of 18 months for the robbery and nine months for the conspiracy.
According to the facts of the case, the appellant and a co-accused met the victim in the course of a small drug transaction. During the incident, the co-accused attacked the victim, took money and caused injuries, whilst the appellant left the scene with him.
The appeal focused exclusively on the District Court's refusal to suspend the sentence. The defence cited the appellant's clean criminal record, his remorse, his cooperation with the authorities, family difficulties and serious health problems.
The appeal judges ruled that although the District Court had considered mitigating factors, it had not weighed them correctly against the circumstances of the case. The judges noted that the appellant did not play a leading role, there was no evidence of organised planning on his part and he had not reoffended since the incident to date.
The custodial sentences remain as they are, but are suspended for three years from the date of the original judgment.
