The Cyprus Bar Association has taken an official position regarding the findings issued by the Independent Authority Against Corruption concerning the book "Mafia State", calling for caution and adherence to the fundamental principles of the rule of law.
In a statement published by Philenews, the Association acknowledges that the Authority's conclusions have caused concern among the Cypriot public, as they concern significant state institutions. At the same time, it clarifies that the existence of indications in the document does not equate to proof of criminal offences.
The Association's position focuses on the need to preserve the presumption of innocence, which constitutes a basic pillar of criminal procedure and an integral component of a fair trial. This principle applies equally to all persons involved in the case. Accordingly, the public handling of the matter should be conducted with respect for the fundamental principles of the legal order.
The Association is closely monitoring developments. Its competent bodies, including the Administrative and Disciplinary Council, are on alert. After receiving the full text of the report from the Independent Authority, the Association commits to studying it in depth and taking any necessary action.
Furthermore, the Association emphasises its institutional duty to examine any potential disciplinary violations by its members that may be referenced in the report. The possibility of conducting a sua sponte disciplinary investigation is not ruled out.
The Legal Service retains the authority to assess the report and decide on the course of any criminal proceedings. The Association prioritises ensuring institutional independence during the investigation.
