Only one of the six attackers who assaulted and brutally beat a fourteen-year-old boy in Ostrava-Hrabůvka in mid-October last year faces criminal prosecution. Police have charged him with extortion, disorderly conduct and robbery. The remaining five violent offenders escaped prosecution because all of them were under fifteen years of age. The incident occurred in mid-October last year in the Ostrava district of Hrabůvka. A group of six assailants attacked the fourteen-year-old schoolboy at that time. Whilst one of the attackers is an adult and police are pursuing him, the other five perpetrators are under fifteen years old and under the law cannot be held criminally responsible.
The charged young man faces three criminal offences. Besides robbery and disorderly conduct, the suspect is also charged with extortion. If convicted of these acts, he faces a sentence of up to five years' imprisonment.
The case highlights the problem of violence amongst juveniles and the limits of criminal responsibility under Czech law. Whilst adult perpetrators may be prosecuted and sentenced to unconditional imprisonment, persons under fifteen years of age fall under the remit of child social and legal protection and do not bear criminal responsibility.
