A 51-year-old gardener has been sentenced to a multi-year prison term for a brutal attack in Munich's Nussbaum Park.

A 51-year-old gardener must spend five years and two months in prison. Munich Regional Court I imposed this sentence for a violent altercation in Munich's Nussbaum Park. The man was additionally found guilty of resisting police officers.
The incident occurred on the evening of 28 June 2025. The convicted man met an acquaintance from the scene in the park, which is known as a meeting place for drug users. He stated that he suffered from serious addiction problems and had wanted to obtain a medication to treat withdrawal symptoms. However, a conflict arose with another man.
The later victim, 48 years old, sustained severe injuries: a fractured skull bone, multiple facial bones shattered, and a jaw broken in two places. In the judges' view, the defendant struck with full force, kicked and continued beating while the victim lay on the ground, strangled him, and subsequently stole personal items from him.
The prosecution suspected that a third man triggered the dispute after allegedly seeing the perpetrator harassing a woman. This witness is said to have called out that one does not hit women. However, as the woman in question could not be found, this allegation remained unproved.
When police officers arrested the gardener, he resisted vigorously. His blood alcohol level measured up to three per mil. Judge Ute Schmitthenner acknowledged an influence of intoxication but rejected reduced criminal responsibility. Long-term alcohol consumption had led to considerable habituation.
The prosecution demanded five years and eight months; defence attorney Markus Brunner argued for at most three years. The court did not order therapy in a detoxification clinic, as an expert assessed successful treatment as unlikely.
