On 1 July 2026, the district court of the capital of the Grand Duchy approved an agreement between the public prosecutor and airline company Cargolux. This decision concerns conduct characterised as passive corruption involving operations conducted on Gabonese territory, over a period extending from 2010 to 2015.
The judicial body clarified that this case concerns only the legal entity Cargolux Airlines International S.A., excluding any prosecution of individuals in particular. The opening of the investigation dates back to a voluntary disclosure made by the company itself at the end of 2015.
Throughout the proceedings, the freight company actively cooperated with investigating magistrates. In return, the court imposed a financial penalty and asset forfeiture with a combined total reaching approximately €1.15 million.
The judicial authorities emphasised that this settlement procedure was made possible by the compliance efforts undertaken by Cargolux since its disclosure. The company implemented measures strengthening its internal control procedures, its regulatory compliance mechanisms and its governance practices. This case sheds light on the decisive role of voluntary disclosures and corporate cooperation with the judiciary in the handling of criminal offences.
