A 25-year-old defendant named Marcelo was tried by magistrates at the Luxembourg district court. He was prosecuted for driving under the influence of narcotics, but the exact type of substance remains undetermined.
Le Quotidien reports (lequotidien.lu) that the young man refused the biological tests that would have established whether it was CBD or THC. Before the judges, he explained his action by a lack of discernment: "I did not measure the consequences of my refusal." He claims to have consumed CBD in the company of a friend before being arrested by a police unit.
However, a test carried out on the spot had detected the presence of THC in his system. The defendant claimed to be unaware that the detection devices could produce this result. The criminal courts of the grand-ducal capital are currently examining several road traffic cases, as the current judicial year approaches its end.
