Luxembourg's Court of Appeal has upheld the convictions of a former social worker in Sanem for rape and sexual abuse, whilst increasing the financial penalties.
Court of Appeal upholds rape conviction of Sanem social worker
Luxembourg's Court of Appeal has upheld the convictions of a former employee of the social services department in the municipality of Sanem for sexual violence offences. The judges also increased the financial sanctions against him, according to Luxembourg Times.
Gilbert T. was found guilty of sexual assault against multiple clients and rape of a woman between 2010 and 2019. At the time, he held a position within Sanem's social services, where he took advantage of the vulnerable situation of women who came to seek assistance.
The victims testified that the accused was initially friendly and courteous, but quickly overstepped professional boundaries. He is alleged to have touched women against their will, both in his office and during home visits. One complainant recounted being raped, whilst others reported unwanted touching.
The former social worker is also said to have exerted pressure on these women by claiming to maintain excellent relations with the mayor, who could reduce their benefits if they spoke out. Several victims remained silent out of fear of losing their housing, until the facts finally came to light.
Gilbert T. was suspended in 2019 and dismissed in 2022. During the first-instance trial in June of last year, he admitted to inappropriate behaviour whilst denying rape. The Luxembourg district court had sentenced him to seven years' imprisonment, five of which were suspended, as well as approximately 5,000 euros in damages.
The Court of Appeal upheld the prison sentence and recognised an additional sexual offence, initially dismissed at first instance. The judges also granted the civil claim of the municipality of Sanem, ordering Gilbert T. to pay one symbolic euro in damages and 500 euros in legal costs. He must also pay 1,000 euros in costs to two women.
The individual has a thirty-day period in which to lodge an appeal, solely on points of procedure.
