Luxembourg district court has ruled on the tragedy that claimed the life of young Emran during the 2019 edition of the Christmas market. According to Le Quotidien, the 16th correctional chamber has attributed exclusive fault to the creator of the artwork and one of his collaborators.
The two individuals received prison sentences of twelve and nine months respectively, both suspended in full. Financial penalties of 5,000 and 1,500 euros were also imposed on them. On the civil side, they will be required to jointly compensate the family of the deceased with a sum exceeding 250,000 euros. The court took into account the fact that procedural delays had been excessive.
Eight other people charged, who worked for the capital's tourism office (LCTO) and for the municipality, had their innocence recognised. This decision goes against the conclusions of the public prosecutor's office, which had pleaded in May for shared fault between the author of the sculpture and the entity that had commissioned it.
Technical analyses had highlighted several construction defects in the installation. The hearing ultimately established that only the craftsman and his companion were to answer for the facts, thereby exonerating the public bodies responsible for the festive event.
