Life sentence for bomb in Siecieborzyce – court toughens sentence for Błażej K.
The Court of Appeal in Poznań sentenced 37-year-old Błażej K. to life imprisonment for placing a bomb at the door of his former partner. Release on probation would be possible at the earliest after 35 years.
Bomb sent to former partner: final life sentence for Błażej K.
According to Dziennik Gazeta Prawna, the Court of Appeal in Poznań issued a final ruling on Tuesday in the bombing case in the village of Siecieborzyce – 37-year-old Błażej K. will spend the rest of his life in prison. Conditional release will be possible at the earliest after 35 years of serving his sentence.
The incident occurred on 19 December 2022. Outside the home of 31-year-old Urszula, someone left a package that looked like a courier delivery. The woman took the parcel inside and when she opened it in the kitchen, a violent explosion occurred. Urszula suffered serious bodily injuries, and two of her children were wounded.
The perpetrator turned out to be Błażej K. – the woman's former partner and father of one of her children. He was charged with attempted murder of five people using explosive materials and with causing serious bodily harm to his former partner and her children, including his own son.
Verdict of the court of first instance and appeals
In March of this year, the District Court in Zielona Góra sentenced Błażej K. to 25 years in prison. The court also imposed a ban on approaching and contacting the victims for 15 years and awarded compensation: 500,000 zlotys for the injured woman and 200,000 zlotys each for the children. In respect of these obligations, the prosecution secured a mortgage on the defendant's house. The court of first instance set the possibility of requesting conditional release at 20 years.
An appeal was filed by both the prosecution and the legal representative of the subsidiary prosecutor – demanding a harsher sentence – as well as by the defendant's defence lawyers, who challenged the evidence and requested an acquittal, a lenient sentence, or the quashing of the ruling and referral of the case for reconsideration.
Court of Appeal: 25-year sentence too lenient
The Court of Appeal in Poznań rejected the defence's arguments and toughened the sentence. In other respects, it upheld the ruling of the court of first instance. The defendant did not appear for the announcement of the verdict.
In justifying the decision, Judge Henryk Komisarski stated that the court of first instance had "correctly assessed the defendant's statements, not believing them on this main point relating to the fact that he consistently denied committing the offence charged and ultimately attributed to him".
The judge indicated that although the case lacked direct evidence of the perpetrator's guilt, the gathered circumstantial evidence formed a closed logical circle. "Like the court of first instance, the court of appeal has not the slightest doubt," Komisarski said.
Motive: hatred and struggle for custody of a child
The judge discussed in detail the defendant's motive for his actions. He indicated that Błażej K. alone had reason to commit the crime. The background was the breakdown of the relationship and a dispute over custody of his minor son – the family court had stripped the defendant of parental rights and established contact with the child only in the presence of a probation officer.
"The defendant expressed his dissatisfaction, but in particular hatred; both towards the victim herself and towards all those who, in his view, contributed to such a ruling," the judge said.
The court cited the content of text messages and procedural documents, which – as Komisarski noted – "clearly indicate that he was absolutely furious with the victim and identified all the disasters that befell him with her".
Planning the attack from autumn 2022
In the ruling, the judge also pointed to the degree of preparation by the defendant. Błażej K. had been collecting pyrotechnic materials since at least the end of September 2022. "His behaviour indicates that the idea of constructing a bomb emerged in his mind, which was to be used to deprive the victim of life, but also with the possible intent to harm other people as well," Komisarski said.
The judge emphasised that only luck and the effective action of the services meant that no one was killed. "But many people were in the blast radius, and the defendant was aware of this," he noted.
Perpetrator's profile: highly dangerous and aggressive
Regarding the length of sentence, Judge Komisarski assessed that 25 years in prison was too lenient a sanction in the circumstances of this case. He cited the opinions of expert psychiatrists and psychologists, according to whom the defendant "is a person who is very self-centred, dominant, who does not tolerate opposition and who is a very aggressive person, inclined to use violence".
The court of appeal shared the position of the prosecution and the victim's legal representative that there is a high probability that Błażej K. poses a persistent threat to those around him. Life imprisonment with the possibility of seeking conditional release only after 35 years was considered an appropriate response to the degree of his guilt and the social harmfulness of the act.
