Judge grants conditional release to Anthonieska Avilés, charged in death of minor
A Puerto Rico judge approved on Tuesday the petition for provisional release submitted by Anthonieska Avilés, who is accused alongside her mother of the homicide of adolescent Gabriela Nicole Pratts, which occurred in August 2025.
Judge Cristina Córdova Ponce ruled in favour of the habeas corpus motion filed by defence lawyers. However, the decision does not mean that Avilés is completely free, as she must comply with a regime of total home confinement for 24 hours a day.
At the hearing held on Tuesday, the defence attempted to postpone the hearing, arguing that they did not have all the documentation required by the Pretrial Services Programme. The judge rejected that request and proceeded to issue her ruling.
The habeas corpus mechanism allows an individual deprived of liberty to request that a court examine whether their detention complies with legal and constitutional standards. When a judge finds irregularities in the detention, he or she can order release, although this does not eliminate the charges or halt the judicial proceeding.
One of the most common reasons for invoking this remedy is excess time in preventive detention. The regulations establish maximum periods for keeping a person in prison before the oral trial begins; when these limits are exceeded, the defence can demand a judicial review of the detention situation.
The criminal proceedings against Anthonieska Avilés are scheduled to begin on 6 April with jury selection. As for her mother, Elvia Cabrera, the selection of twelve citizens—eight female and four male—who will decide on her responsibility in the case has already been completed.
Both women face charges of homicide and offences related to the Firearms Law, linked to the death of the minor, who was 16 years old.
