Carver Man Accused of Racially Motivated Attack at Cumberland Farms in Kingston

A 46-year-old Massachusetts man with a documented history of violence is facing hate crime charges after allegedly assaulting a Black man at a Kingston petrol station on Tuesday morning, fallriverreporter.com reports.

According to police, officers responded just after 7:30 a.m. to the Cumberland Farms at 41 Main Street in Kingston after reports of a fight in progress. The victim, a Black man, told officers he was standing at the fuel pumps when Gary Phillipo II of Carver approached him and began yelling racial slurs without provocation.

Phillipo then charged at the victim. He allegedly kicked him, struck him multiple times, and knocked him to the ground. The victim fought back and sustained several injuries, including a suspected compound fracture.

Officers identified Phillipo as the primary aggressor following their investigation. Multiple witnesses provided statements corroborating the victim's account, describing the suspect as out of control and acting irate. Phillipo continued to shout racial slurs while officers were present.

Officer Oxsen arrested Phillipo at the scene. At the police station, Phillipo complained of injury and was taken to hospital, where he continued to be disruptive — yelling profanity and racial slurs at officers and medical staff and making sexualised comments in the emergency room.

In the days following the arrest, Officer Oxsen obtained surveillance footage from the Cumberland Farms location. The video appeared to further corroborate the victim's account of an unprovoked attack.

Phillipo was arraigned at the courthouse and charged with Assault and Battery with a Dangerous Weapon Causing Serious Bodily Injury, Assault and Battery to Intimidate Resulting in Bodily Injury (Hate Crime), and Disturbing the Peace. He remained in custody following arraignment and is scheduled to return to court next month.

Phillipo was found to have a lengthy history of violence, according to the report.
