Carver Man Arraigned on Hate Crime Charges After Assault at Kingston Cumberland Farms
A 46-year-old Massachusetts man has been charged with a hate crime following an unprovoked attack on a Black man at a Kingston gas station, newslinklive.com reports.
Officers responded to Cumberland Farms at 41 Main Street in Kingston at shortly after 7:30 a.m. on Tuesday after reports of a fight in progress. The victim told police he was standing at the gas pumps when Gary Phillipo II, of Carver, approached him and began shouting racial slurs without provocation.
Phillipo then charged at the victim, kicking and striking him multiple times before knocking him to the ground. The victim fought back and sustained several injuries, including a suspected compound fracture.
Investigators determined Phillipo was the primary aggressor. Multiple witnesses provided statements corroborating the victim's account, describing the suspect as out of control and acting irate. Phillipo continued shouting racial slurs in the presence of responding officers.
Officer Oxsen arrested Phillipo at the scene. At the police station, the suspect complained of injury and was transported to hospital, where he continued to disturb the emergency room — yelling profanity and racial slurs at officers and staff and making sexualized comments.
Phillipo was found to have a lengthy history of violence. He was subsequently transported to court for arraignment.
In the days following the arrest, Officer Oxsen obtained surveillance footage from Cumberland Farms that appeared to further corroborate the victim's account of an unprovoked attack.
Phillipo was charged with Assault and Battery with a Dangerous Weapon Causing Serious Bodily Injury, Assault and Battery to Intimidate Resulting in Bodily Injury — a hate crime charge — and Disturbing the Peace.
He remained in custody following arraignment and is due back in court next month.
