Kentucky appeals court orders new hearing in Georgetown College rape conviction
The Kentucky Court of Appeals has ordered a new evidentiary hearing in the case of Cody Arnett, convicted of raping a student inside a Georgetown College dormitory in 2018, wkyt.com reported Friday.
The appeals court upheld a lower-court ruling that the hearing is necessary to establish whether witness recordings were withheld from the defence. The court also noted that the assistant commonwealth's attorney declined to cooperate when asked to provide an affidavit.
According to police, security footage from the night of the incident showed Arnett moving through the area just after 2 a.m., stopping in front of multiple apartments before entering the victim's unlocked unit shortly before 3 a.m.
Once inside, Arnett woke the victim and raped her at knifepoint.
