US Magistrate Lauren Louis denied the defence motion for release, meaning the brothers will stay jailed throughout what could be a months-long extradition process. Louis stated in her ruling that the Tates "have failed to meet their burden to demonstrate that they do not present a risk of flight or danger to the community, or that special circumstances warrant their release."
"Having failed to meet these three factors, Respondents' Motion for Release Pending Extradition Proceedings is DENIED," Louis wrote.
Defence Cites Legal Contradiction
The brothers' legal team issued a statement following the ruling, arguing that their clients are caught in an untenable legal position. The Tates are being held in the United States on the basis of a British extradition request while simultaneously being required to participate in ongoing criminal proceedings in Romania.
"They are now facing an extraordinary situation in which they are being held thousands of miles from Romania while Romanian proceedings continue, deadlines approach, an additional indictment is said to be imminent and their own Romanian lawyer says he cannot properly prepare," lawyers said in the statement.
The defence also contended that meaningful legal preparation is impossible under the current conditions. "No serious person can pretend that this can be reviewed properly through occasional conversations from a federal detention centre in another country," the statement read.
Lawyers for the Tates had asked the court to grant the brothers provisional release at least until an extradition hearing could be scheduled on the UK rape and trafficking allegations.
Long-Running International Legal Saga
The ruling is the latest development in a protracted legal case spanning three countries — the United States, the United Kingdom and Romania. The brothers have been held at the Federal Detention Center in Miami since making their first court appearance two days after their arrest on 18 July.
Their defence has repeatedly argued that Britain's extradition request is premature because their criminal proceedings in Romania are set to take precedence. Romanian authorities had previously allowed the brothers to remain free pending the conclusion of those proceedings, during which time neither man attempted to flee or violated any court-imposed restrictions. Earlier this month, Romanian prosecutors filed additional charges against them.
Prosecutors countered that the Tates represent a significant flight risk, pointing to what they described as considerable financial resources and the brothers' own public boasts about holding multiple passports.
Who Are the Tate Brothers?
Andrew Tate is a former professional kickboxer who has accumulated more than 10 million followers on X, the majority of them boys and young men. He has been banned from platforms including YouTube, TikTok and Instagram for breaching hate speech policies. He describes himself publicly as a misogynist and operates an online academy in which he claims to teach young men how to accumulate wealth and attract women.
His brother Tristan Tate is also a former kickboxer.
The pair have built one of the internet's most polarising social media empires, centred on the promotion of wealth, male dominance and misogynistic viewpoints. During a hearing in Miami last month, the brothers denied all criminal accusations across multiple jurisdictions, describing their confrontational online personas as exaggerated characters distinct from their actual personalities. Andrew Tate stated that claims of extreme wealth were inflated deliberately to increase his social media profile.
Both brothers are avid supporters of US President Donald Trump.
