Al Ain fatal crash lands driver and owner with AED295,294 insurance bill
An Al Ain court has ordered an unlicensed driver and the owner of the vehicle involved to repay an insurance company Dh295,294 ($80,406), plus late payment interest and legal fees, following a fatal road crash, emirates247.com reports.
The accident occurred in Al Ain on 17 February 2024. The driver, who did not own the vehicle, was behind the wheel without a valid licence. The Al Ain Traffic Misdemeanours Court subsequently convicted him on charges of causing death, damaging third-party vehicles, failing to comply with traffic signs, and driving without a licence, according to court documents seen by The National.
The vehicle owner faced no penalties in the criminal proceedings.
Following the conviction, the insurer paid out Dh295,294 to settle all claims arising from the crash. That sum comprised Dh227,706 to the family of the person killed, Dh29,034 to repair one damaged vehicle, Dh31,784 for damage to a second vehicle, and Dh6,770 in ambulance costs.
The insurance company then filed a civil case seeking reimbursement from both the driver and the vehicle owner under the terms of the UAE's unified motor insurance policy.
The judge upheld the insurer's claim, ruling that the driver had operated the vehicle without a valid licence and that the company had duly compensated all third parties involved.
The court rejected a separate request from the vehicle owner to deduct the Dh200,000 he had already paid to the deceased's family as diya — Sharia-compliant blood money payable when an unlawful act causes death or serious injury. Both parties were ordered to cover court and legal costs in addition to the principal sum.
