Court of Appeals overturns ruling on homicide in La Paz district and orders new pre-trial hearing
According to fiscalespenalesalta.gob.ar, the appellate judges Leonardo Feans and Mónica Mukdsi overturned the sentence that had eliminated the aggravating circumstance of treachery in the case concerning the homicide of Bautista Benjamín Mamaní, a teenager killed in the La Paz district of the city of Salta.
The contested ruling had been issued by the judge of the Centro district, Francisco Mascarello, during the pre-trial hearing. Mascarello had sent the case to oral trial without the aggravating circumstance of treachery that the criminal prosecutor Daniel Espilocín, from the Unit of Serious Crimes against Persons, had maintained in his charge.
After hearing the arguments of the parties at the appellate hearing, Feans and Mukdsi decided to nullify that decision and order a new pre-trial hearing.
The defendants are Gustavo Mauricio José Gómez, charged as the perpetrator of homicide aggravated by treachery, and Jorge Raúl Gómez, as an accessory to the crime.
According to the prosecution's theory, the incident occurred on 11 August 2025, at approximately 22:40, in the sports ground located in the vicinity of block 457 "C" of the La Paz district, in the south-eastern area of the city of Salta.
At that location, a fight between two groups of young people would have taken place. When Mamaní attempted to leave on his motorcycle, the two defendants would have intercepted him in a coordinated manner: one struck him and the other inflicted a knife wound to his chest with a blade.
The teenager managed to reach the vicinity of his home, where family members assisted him and transported him to Papa Francisco hospital. He was admitted to that healthcare facility without vital signs. The post-mortem examination determined that the cause of death was hypovolemic shock and cardiac tamponade.
