Moderna.immo Real Estate GmbH, based in Klagenfurt, filed for insolvency on Tuesday—the third company of the same managing director within a matter of weeks. This is reported by credit protection agencies KSV 1870 and AKV, as well as by Kleine Zeitung.
The Moderna GmbH, founded in 2021, was engaged in the property and housing sector according to the insolvency petition. The Alpine Creditors' Association (AKV) puts current liabilities at 17,000 euros, with virtually no assets present. Employees are not affected by the insolvency. According to the AKV, the company remains closed and business licences have been returned. Whether a restructuring plan is planned remains to be seen.
"The exact status of assets and liabilities will need to be determined in the course of the proceedings," states KSV 1870.
The AKV announces the next insolvency in its statement: the sole shareholder of Moderna.immo Real Estate is Luxberg Immobilientreuhand GmbH, over which insolvency proceedings are also to be opened.
Klagenfurt lawyer Martin Mutz was appointed as insolvency administrator. He is already managing the insolvencies of WKI Hausverwaltung GmbH and Kärntner Immobilienmanagement GmbH (KIM), both of which filed for insolvency on 21 October.
All three companies have the same managing director. After two voluntary disclosures and a further report, Klagenfurt public prosecutors are investigating him on suspicion of embezzlement of client funds. According to current information, the damage is said to amount to more than 830,000 euros. The man is owner of several companies in the property and property management sector.
The presumption of innocence applies to the accused managing director.
