The Federal Court has admitted the appeal of an Indian worker who had filed a complaint for human trafficking in Geneva. The investigation had lasted more than seven years and concluded with a case dismissal.

A worker from India who had filed a complaint for human trafficking in Geneva has won his case before the Federal Court. The highest judicial authority admitted his appeal and returned the file to the cantonal court.
The case dates back to a criminal investigation that lasted seven years and nine months. During this period, no fewer than six different prosecutors succeeded one another at the Geneva prosecutor's office. Ultimately, the procedure ended with a case dismissal order. The complainant in particular demanded that a violation of his right to effective and swift proceedings be established.
The defendant in this case died on 1 March. Consequently, the criminal prosecution will be extinguished. Nevertheless, the complainant will be able to obtain answers about the delays accumulated during the investigation.
The Court of Justice sitting at Mon-Repos considers that it does not have sufficient information concerning the causes of these delays. It has therefore decided to return the file to the cantonal court so that it may investigate this question further and make a new ruling.
