A judge imposed three months of preventive detention against a woman accused of taking the life of her 10-year-old daughter in the Batey Bienvenido sector of Manoguayabo, according to a statement issued Tuesday by the Public Ministry. The measure was ordered by the Judicial Office of Permanent Care Services of Santo Domingo Oeste, following an incident recorded last Saturday.

According to infobae.com, the investigation is being led by prosecutor Manuel Medrano. According to the case file, the accused allegedly used an electric tool to cause the death of the girl whilst both were alone in a room of the family home.

A brother of the accused surprised her at the moment she was holding the child between her legs and was inflicting wounds to her neck. These injuries proved fatal, according to the judicial report.

Evidence and legal grounds

The prosecuting attorney José Manuel Polanco supported the request for preventive detention by presenting evidence which, according to the case file, demonstrates that the accused violated Articles 295 and 304 paragraph II of the Dominican Penal Code. These articles punish the crimes of homicide and murder when the victim is a minor.

Judge Cecilia Toribio ordered that the coercive measure be carried out in the psychiatric ward of the Correction and Rehabilitation Centre (CCR) Najayo Women, located in San Cristóbal province. The decision took into account both the facts of the case and the mental health condition of the accused, in accordance with the case file presented by the Public Ministry.

Legal framework for child protection

The Dominican Republic bases the protection of children and adolescents on Law No. 136-03, which created the Code for the Protection System and Fundamental Rights of Children and Adolescents. That law replaced Law 14-94 and brought Dominican legislation into line with the standards of the UN Convention on the Rights of the Child.

Its principles include the best interests of the child, shared responsibility between family, State and society, and free access to procedures such as civil registration and the restoration of rights. The code also establishes protection against abuse and exploitation, with an explicit prohibition on physical or psychological mistreatment, sexual exploitation and dangerous child labour or work carried out before the age of 15.

The regulations also provide for mandatory access to immunisation schemes, comprehensive medical care and basic education, and prohibit the dissemination without authorisation of the image or identity of minors in media outlets or digital platforms.
