The three-judge felony court of appeal in Larissa accepted the presentation supporting the charge brought by the Greek state, despite the prosecutor's opposing recommendation.

The three-judge felony court of appeal in Larissa accepted the presentation supporting the charge brought by the Greek state and the families of victims regarding the offence of breach of duty, according to ERT. By contrast, the representations of the Panhellenic Union of Railway Personnel — the train drivers' union — as well as those of the bar associations were rejected.
Notably, the prosecutor had recommended the exclusion of the Greek state from the proceedings, but the court decided to accept its representation. Following these decisions, those presenting in support of the charge number more than 150, consisting primarily of the families of victims and survivors.
The defence counsel for the three station managers and the inspector had raised objections both to the representation of the bar associations and to that of the Greek state. The court's decision provoked strong reactions among the families and their lawyers, who believe that in this manner the "narrative of human error" is being reproduced.
