Camera found in women's toilets: police seizes device

Approximately three weeks ago, a camera was discovered in the women's toilets of a Luxembourg company, according to L'Essentiel. It was an unexpected detail that led to the discovery: visible dust at toilet level prompted a person to look up, thereby revealing the device.

Police intervened and seized the equipment. "The camera was seized by law enforcement," the prosecutor told L'Essentiel. "Checks revealed that the camera's memory card was empty and no images had been recorded or captured." The investigation is continuing under police responsibility and, at this stage, no person has yet been arrested. The management of the company concerned had not responded to requests at the time of publication.

Voyeurism law came into force in 2021

Filming a person in toilets has been punishable in Luxembourg since April 2021, when a specific article of the penal code came into force — article 385ter — which penalises "any means used to view the intimate parts or underwear of a person (...) when committed without the knowledge or consent of the person". The suspected perpetrator faces between two months and one year's imprisonment as well as a fine of between 251 and 30,000 euros.

Despite its relatively recent introduction, this law has already been cited in three judgements, according to the prosecutor. In one of them, a volleyball coach was sentenced to five years' imprisonment, three of which suspended, for filming his players in the shower and transmitting the images to 139 men; one of these recipients received two years' imprisonment with full suspension and a fine of 2,000 euros. In another case, the court of appeal handed down a sentence of six years' imprisonment, 42 months of which suspended, against a man who had filmed his niece in the toilets of a primary school.
