TSJ transfers trial for teenage fisherman's homicide to Caracas

Homicide case of fisherman transferred to Caracas Criminal Judicial Circuit
The Criminal Cassation Chamber of the Supreme Court of Justice (TSJ) ordered the transfer to Caracas of the trial against four citizens for the alleged death of a teenage fisherman in La Guaira state, according to elimpulso.com.
The defendants—José Pinto Marrero, José Fidel Blanco, Jesús Sánchez Roquett and Jesús Manuel Ibarra—face charges of intentional homicide qualified with treachery for futile and ignoble motives, criminal association and unlawful deprivation of liberty. The case had been heard until now by the Fourth Court of First Instance in Control Functions of the Criminal Judicial Circuit of La Guaira state.
The decision was established in sentence No. 48-2020, with the report of magistrate Yanina Beatriz Karabín de Díaz, who ruled favourably on the application for transfer submitted by the Public Ministry.
The ruling of the High Court notes that the crime, in violating the right to life of a poor young adolescent fisherman, generated a sense of alarm and public scandal among the population of La Guaira. The decision further emphasises that one of the alleged perpetrators, José Pinto Marrero, is an active member of the board of directors of the Tupamaro political party in that state, which gives the case a political dimension of national scope.
The court also considered that the extensive coverage of the case in digital and television media throughout the country constituted a communicational phenomenon capable of affecting the normal development of proceedings in La Guaira, thus fulfilling the parameters of numeral 1 of article 64 of the Organic Criminal Procedural Code to justify the transfer.
Consequently, the Chamber ordered the Presidency of the Criminal Judicial Circuit of La Guaira state to immediately remit the original case file to the Presidency of the Criminal Judicial Circuit of the Metropolitan Area of Caracas, for its subsequent distribution to one of the Courts of First Instance in Control Functions.
