An off-duty Immigration and Customs Enforcement agent was arrested early Friday after allegedly attacking a woman and her 72-year-old father outside their home in Fresno, California, abcnews.com reports. The father shot the agent once during the altercation, wounding him in the midsection.
The Fresno Police Department identified the agent as David Gonzalez, 32, of Texas. Officers found him in handcuffs with a gunshot wound after responding to multiple 911 calls reporting the shooting.
According to police, the woman arrived home to find Gonzalez sleeping on her front lawn. She alerted her father, with whom she lives, and he went outside to send Gonzalez away. When Gonzalez woke up, he "appeared intoxicated and agitated" and allegedly assaulted the older man.
"When the victim's daughter tried to intervene on her father's behalf, Gonzalez physically attacked her, at which time she went to the ground," Fresno police said in a statement.
The father then produced a legally owned firearm and fired one shot at Gonzalez, striking him in the midsection. The woman subsequently called her boyfriend — an off-duty police officer — who arrived at the scene and placed Gonzalez in handcuffs before uniformed officers arrived.
Gonzalez was transported by ambulance for medical treatment and is currently in custody on felony assault charges. The names of the woman and her father were not released by police; their injuries are still being evaluated.
The 72-year-old man who fired the shot is not facing criminal charges. Police said he "feared for the physical safety of both himself and his daughter" and that the investigation supported that assessment. He legally possessed the firearm, police confirmed.
Fresno police confirmed Gonzalez was off-duty and alone at the time of the incident. "It is unknown at this time why Gonzalez was in the area," the department said.
ABC News said it reached out to the Department of Homeland Security for comment and had not immediately received a response. It remains unclear whether Gonzalez has legal representation.
The Fresno Police Department said the investigation is ongoing and that detectives are seeking additional witnesses and any available video footage of the incident.
