Moncton driver faces four charges after crash kills two, released under strict conditions

Dominique Marshall, 25, was granted conditional release on Friday following a fatal head-on collision in Moncton that killed two teenagers, cbc.ca reports.

Police say Marshall was behind the wheel of a car that crossed the centre line on Berry Mills Rd. just before 7:30 p.m. on Monday, striking an oncoming SUV. A 16-year-old girl and an 18-year-old man — both occupants of Marshall's vehicle — died at the scene. A 14-year-old boy and a 16-year-old boy, also in the car, were taken to hospital; the latter in critical condition. Five people travelling in the SUV, all from Arkansas, were treated for minor injuries.

Marshall was arrested the same night and charged two days later with two counts of dangerous driving causing death and two counts of dangerous driving causing bodily harm.

On Friday, he appeared in virtual bail court by phone from hospital, where he has remained since the crash. Judge Scott Brittain told Marshall: "The Crown is prepared to consent to your release provided you enter into a release order."

The release conditions Marshall agreed to sign include a curfew between 10 p.m. and 6 a.m., a prohibition from sitting in the driver's seat of any motor vehicle, and no contact with anyone under the age of 18 outside his immediate family.

Marshall spoke only to confirm his agreement to the conditions and to clarify the terms of the order. The court noted he has not yet applied for legal aid but has been instructed to do so before his next court date.

He is scheduled to return to Moncton Provincial Court on Oct. 30 to enter a plea.
