On that occasion, the officer was driving a car when he struck Domingo Villafañe, a retired sub-officer aged 72 who was travelling by bicycle at the intersection of Circunvalación avenue and Salta street in the provincial capital. Villafañe died days later from the injuries he sustained.

The administrative inquiry considered that the conduct attributed to Aciar seriously compromised the honour of the position and damaged the reputation of the police institution. As an aggravating factor, the harm caused to the force's image was taken into account.
