Only late in the evening was the man brought before a police legal adviser. By that time he was already dependent on a wheelchair and could no longer walk independently. A witness described his condition as that of a "patient requiring care". The prosecution accuses the legal adviser of deliberately abusing his authority by conducting an interrogation with the man who was clearly suffering from health impairment.
The charges include abuse of office and torture or neglect of a prisoner. The officer who injured the man at Schwarzenbergplatz must answer for negligent grievous bodily harm with serious health consequences. The prosecution believes there was no intent on his part – a diversion settlement is being considered. The prosecutor is taking a significantly harsher line against the three other defendants.
All four are presumed innocent.
