Former tax auditor from Operation Icarus released after 294 days in custody in São Paulo

A São Paulo court has ordered the release of former tax auditor Artur Gomes da Silva Neto, a defendant in Operation Icarus, which is investigating the alleged fraudulent approval of ICMS tax credits with the State Tax Authority (Sefaz-SP), as reported by g1.globo.com.
The decision was signed by Judge Thiago Baldani Gomes de Filippo, of the 1st Court for Tax Crimes, Criminal Organisations and Money Laundering in the Capital. Artur had been held in pre-trial detention since August 2025 — 294 days of precautionary custody.
Procedural equality as grounds
The magistrate acknowledged evidence of Artur's participation as the "central articulator" of a highly sophisticated criminal organisation that moved more than R$ 1 billion in the department, but concluded that pre-trial detention was no longer justified. The main argument was the principle of procedural equality: the legal and criminal situation of the defendant is similar to that of other accused parties who have already had their detention revoked or replaced.
The judge cited two specific cases. Marcelo de Almeida Gouveia obtained the replacement of pre-trial detention with precautionary measures by decision of the São Paulo Court of Justice. Celso Eder Gonzaga de Araújo had his detention converted to home confinement by decision of the Superior Court of Justice. According to the decision, there are no substantial differences between the conduct attributed to Artur and that of the other co-defendants in the corruption crimes under investigation.
The magistrate also emphasised that Artur has no prior criminal record and that the time already spent in precautionary custody was lengthy, making it unnecessary to maintain the extreme measure.
Indictment for 92 crimes
Artur and his mother, Kimio Mizukami da Silva, were charged by the São Paulo Public Prosecutor's Office (MP-SP) with 46 alleged crimes of passive corruption and 46 alleged crimes of money laundering. The other accused in the case face only charges of passive corruption.
Operation Icarus arrested, in addition to the former tax auditor, the owner of the Ultrafarma pharmacy chain and directors of the Fast Shop company, accused of benefiting from the fraudulent scheme allegedly run by Artur within the São Paulo government. According to the investigation, the auditor facilitated the process of tax credit reimbursement to favour companies in exchange for bribes.
Series of precautionary measures
With the revocation of detention, Artur will now comply with a set of restrictions determined by the court. He must maintain the suspension of his public office duties and is prohibited from accessing the State Tax Authority of São Paulo, tax offices and fiscal systems.
The defendant is also prohibited from maintaining contact, by any means — directly or indirectly, including through third parties — with other tax agents under investigation. He cannot leave the jurisdiction without prior judicial authorisation, must surrender his passport within 24 hours and is barred from obtaining a new travel document without court authorisation.
Furthermore, he will be subject to home confinement during the night-time hours, from 10 p.m. to 6 a.m., and during weekends. The judge also ordered the use of an electronic ankle monitor, with surveillance under the responsibility of the Penal Police, linked to the Penitentiary Administration Secretariat, which will conduct fortnightly unannounced visits.
The magistrate warned that failure to comply with any of the measures could result in a new decree of pre-trial detention.
Defence speaks of "serenity"
Artur's defence, represented by lawyer Júlio César De Nigris Boccalini, stated in a note that it "receives the decision with serenity, balance and confidence in the conduct of the institutions".
"After 294 days of precautionary custody, Artur will be able to respond to the process at liberty, strictly complying with the judicial determinations and awaiting the facts to be examined under adversarial proceedings, in light of due process of law and procedural truth," said the lawyer.
According to Boccalini, the defendant "will remain at the disposal of the court" and the defence will continue to act "with discretion, firmness and confidence that the necessary clarifications will be produced in the regular course of the process".
