Jury court condemns father to more than 83 years for death of son Théo in São Gabriel
The Jury court condemned, on Wednesday (4), Tiago Ricardo Felber to 83 years and 4 months' imprisonment for throwing his own son, Théo, from a bridge in São Gabriel, on the western border of Rio Grande do Sul. According to cnnbrasil.com.br, the crime was motivated by revenge against the ex-wife, the child's mother.
Felber was convicted of qualified homicide, attempted qualified homicide and threatening, with the sentence to be served in a closed regime from the outset. The court ordered immediate execution of the sentence and set a minimum indemnity of R$ 100,000 for the victim's family.
The prosecution was pursued by public prosecutors Maria Fernanda Rabelo Ramalho and Graziela Lorenzoni. "The conviction represents a firm response from the courts in the face of the severity of violence perpetrated against a child and, above all, recognition of the importance of Théo's life and the suffering of his family," said Maria Fernanda.
Graziela highlighted the repercussion of the case beyond the trial: "It was an important conviction by reason of the fact that Théo's death was one of the cases that motivated the creation of the crime of vicaricide in Brazil."
The trial lasted more than 13 hours. Eight people were heard: Théo's mother — also a victim of the threatening charge —, two witnesses called by the Public Ministry of RS, three by the prosecution assistance and one by the defence. The defendant was also questioned. After the debates, the Sentencing Panel decided on conviction.
The child, who lived with his mother in Nova Hartz, was taken by his father on 22 March to celebrate his 40th birthday. On 25 March, the body of Theo Ricardo Ferreira Felber was found by police.
Shortly after throwing the boy, Felber sent an audio message to his ex-partner: "Keep your heart strong for the rest of your life, I threw Théo off the bridge just now."
In his statement, he confessed to having tried to strangle his son on the day before the crime. Théo was thrown alive from a bridge approximately 15 metres high. The forensic report indicated cranioencephalic trauma resulting from the fall as the cause of death.
