Sentenced to 20 years in prison for aggravated homicide at Persa Biobío in Santiago
Santiago's Fourth Criminal Trial Court sentenced Ham Steven Angulo Riascos to 20 years' effective imprisonment for the murder of a Colombian citizen in May 2022.
Unanimous ruling condemns crime perpetrator to 20 years
The Fourth Criminal Trial Court of Santiago handed down a sentence of 20 years' effective imprisonment against Ham Steven Angulo Riascos, declared responsible for the consummated offence of aggravated homicide with treachery and known premeditation, according to g5noticias.cl. The court acted unanimously.
The victim, Carlos Arley Montes Quintero, 40 years old and of Colombian nationality, was attacked on 3 May 2022 at approximately 16:20 hours inside Persa Biobío, specifically in corridor 16 opposite commercial premises No. 830 on Placer Street No. 880, in the Santiago municipality.
According to the facts which the court determined beyond reasonable doubt, Angulo Riascos and a second defendant identified as Diego Antonio Asprilla Alomia acted in concert and armed with firearms. Both opened fire at close range and repeatedly against the victim, causing immediate death from traumatic brain injury caused by ballistic projectile. Following the attack, the assailants fled running towards the car park area, boarded a vehicle that was waiting for them outside, and escaped along Centenario Street heading west.
Second conviction for illegal weapons possession
In the same ruling, the court sentenced Angulo Riascos to 3 years and one day of effective imprisonment as perpetrator of the offence of possession of a prohibited firearm. The incident occurred on 17 July 2023, at 18:10 hours, during the execution of a judicial order for entry and search of a residence at Conde del Maule Street No. 4325, apartment 1612, in the Estación Central municipality. During that police procedure, the defendant was found in possession of a Taurus brand revolver, calibre .38 Special, manufactured in Brazil, with the serial number intentionally erased and with cartridges in the chamber. The court ordered the confiscation of the seized weapon.
Ancillary penalties and DNA registration
Along with the principal sentence of 20 years, the judgment imposes absolute perpetual disqualification from holding public office and positions and from exercising political rights, as well as absolute disqualification from practising licensed professions whilst the sentence remains in effect. Once the ruling becomes final, the taking of biological samples from the sentenced person was ordered to determine his genetic profile and incorporate it in the National DNA Register of Condemned Persons.
Notification to Migration Authority due to foreign status
The resolution also includes a specific instruction derived from the sentenced person's migration status. "As the condemned person holds the status of foreign citizen, compliance shall be given to article 145 of Law No. 21.325, with notification of this judgment to the National Migration Service within a period of five days from the date this judgment becomes final," the ruling states.
