The Oral Criminal Court of Valparaíso issued a conviction against a man who murdered a 19-year-old youth in a pub located on Ecuador Subida in the port. Judge Juan Carlos Arriagada imposed a sentence of life imprisonment as the perpetrator of the crime of aggravated murder.
The facts occurred in the early morning of 28 July 2023, when the accused, accompanied by other persons, entered the nightclub in search of a supposed victim of a robbery that had allegedly occurred minutes before. Upon failing to find the alleged perpetrator, the condemned man assaulted the 19-year-old youth, who had no connection to the theft, causing his death.
The court determined that the attack was committed with treachery, as the aggressor took advantage of his superior conditions and the victim's defenceless situation. Furthermore, the participation of third parties who collaborated in the facts was established, although they were not tried in this proceeding.
During the trial, the Public Prosecutor successfully demonstrated the criminal responsibility of the accused through testimony, expert reports and audiovisual evidence gathered at the scene. The defence attempted to mitigate the conduct of the accused, but the court did not accept such arguments.
The sentence was received with satisfaction by the victim's family members, who had demanded justice from the beginning of the investigation. The case generated shock in the port community due to the brutality of the crime and the youth of the victim.
The condemned man must serve his sentence in a penitentiary facility in the Valparaíso region and will not be able to access prison benefits for the first 20 years of his sentence, in accordance with Chilean legislation for crimes of this severity.
