Life sentence for murder of wife and staging of accident – Gdańsk Court of Appeal ruling
The Gdańsk Court of Appeal changed the sentence for Tomasz K. from 26 years in prison to life imprisonment for the premeditated murder of his wife and staging her death as a railway accident.
Gdańsk Court of Appeal: life sentence for premeditated murder of wife
The Gdańsk Court of Appeal ruled on Monday that Tomasz K., who in January 2024 murdered his wife and subsequently staged her death as a railway accident, should receive life imprisonment. According to rp.pl, the court thereby increased the total sentence from 26 years in prison that had been imposed by the court of first instance.
Premeditated crime
According to the court's findings, Tomasz K. went to the beauty salon where his wife Jolanta worked. He took a hammer from home and struck the victim eleven times in the head. He then transported the body to a railway crossing in Mezów in Kashubia, where he abandoned it, creating the appearance of a traffic accident.
To corroborate his alibi, K. left a light switched on in the garage and his mobile phone. The court also established that the man was familiar with train timetables, which testifies to the careful planning of the entire action.
The motive for the crime was the breakdown of the marriage, which the defendant could not come to terms with.
Justification for the sentence
The presiding judge Leszek Mering stressed in his justification that the circumstances of the act have been fully proven and raise no doubts whatsoever. The appellate court accepted in their entirety the factual findings of the district court.
"The defendant's behaviour was not impulsive or momentary in character. Quite the opposite – it was fully deliberate and carefully considered in nature," stated Judge Mering, adding that Tomasz K. had worked out the plan and its method of execution in cold blood.
The court noted that the defendant's explanations during the proceedings were variable and adjusted to the current procedural situation. The version of sudden events that K. had presented was rejected by the court.
"The objective circumstances concerning the act, as well as those of a subjective character, require that we accept that no sentence other than life imprisonment would realise against him the objectives specified by law," Judge Mering explained. "The defendant is a highly demoralised person who should be isolated from society."
The court also characterised Tomasz K. as a selfish individual for whom human life has no value whatsoever, and the principal function of the sentence against him should be preventive and protective.
Sentence in accordance with demands of family and prosecutor
The appellate court agreed with the position of the prosecutor and the subsidiary accusers, who had demanded life imprisonment, considering the claim of gross disproportionality of the 26-year sentence to be justified. In the court's view, the first instance had not accorded proper weight to the circumstances determining the measure of the sentence.
In December of last year, the Gdańsk District Court sentenced Tomasz K. for murder, causing a catastrophe in land transport, and property damage to a total sentence of 26 years in prison. The defendant admitted guilt during the investigation and before the court of first instance, but – as the court noted – consistently minimised his culpability. He did not appear in court for the announcement of the appellate judgment.
Compensation for the victim's family
Tomasz K. is also obliged to pay compensation to the relatives of murdered Jolanta K. The victim's parents – Danuta and Jerzy B. – will each receive 150,000 zloty. Her siblings: Beata, Kacper, Jacek and Marek B. – will each receive 100,000 zloty.
