The Warsaw Regional Prosecutor's Office has decided to dismiss the investigation for a second time into injuries sustained by a young woman during a police arrest in December 2020.
The incident occurred on 9 December outside the headquarters on Wilcza Street. A group of people organised an unannounced protest under the slogan "Walk for the Future". Demonstrators demanded the release of previously detained participants in a climate action.
Due to the sanitary restrictions in force at the time, officers called on those gathered to leave the area. After unsuccessful attempts at persuasion, a decision was made to forcibly remove the demonstrators.
During the operation, a physical confrontation took place. One of the officers subdued the 19-year-old participant by grabbing her left arm. The woman began to experience severe discomfort and was taken to hospital. There, a spiral fracture of the shaft of the humerus was identified.
At the first stage, the proceedings were concluded. The injured party's representative filed an appeal, which the court upheld, ordering the investigation to be resumed and supplementary measures to be carried out.
The prosecutor re-interviewed witnesses, thoroughly analysed CCTV recordings, and obtained an additional expert opinion regarding subduing techniques.
After conducting all investigative measures, the investigator maintained his previous position. The justification emphasised that the injuries were caused accidentally and not as a result of intentional action or negligence on the part of the officer. In the prosecutor's view, the force used against the woman was adequate to the circumstances.
The woman's representative announced the filing of another appeal against the decision of the prosecution authority.
