The Regional Court in Warsaw decided to uphold the precautionary measure in the form of remand in custody against Zbigniew Ziobro. The ruling in this case has become legally binding, which means that no further appeals are available against it.
Court spokeswoman Anna Ptaszek confirmed that the order has fundamental significance for the ongoing extradition proceedings. Thanks to the finalisation of the decision on detention, Polish authorities can prepare and submit a formal request for the extradition of the former minister from the United States. Without such a ruling, the American court could reject the extradition request.
The hearing, during which the decision was handed down, began on Wednesday 1 July at 9:30. Ziobro's legal team requested the disqualification of judges from the three-judge panel. They argued that one of the judges had previously upheld remand in custody for Marcin Romanowski, which was said to be a circumstance that should have excluded her from participating in the case. The court did not accept these arguments. Similarly, the request to suspend proceedings was rejected.
It is worth noting that in the initial stage of the case, a randomly selected judge voluntarily requested to be disqualified from the panel due to connections with another matter. In the subsequent panel, the defence disputed the impartiality of the court members, however these objections were not upheld.
Zbigniew Ziobro is currently abroad. Polish prosecution authorities intend to bring him back to the country under international judicial cooperation. The final ruling on the arrest warrant strengthens the position of the Polish side in the forthcoming procedures before the American judiciary.
