The Olsztyn prosecutor's office has turned to the chief public prosecutor with a request to challenge the verdict against Paweł K. – a lawyer from Łódź who caused a tragedy on a road in the Warmian-Masurian region. Spokesman Daniel Brodowski explained to PAP that the district court incorrectly assessed the course of the collision.
The incident occurred on 26 September 2021 between Barczewo and Jeziorany. The vehicle driven by the defence lawyer from Łódź struck another car travelling in the opposite direction. In the vehicle that was hit, there were two female passengers aged 53 and 67 – both died.
In April 2023 the first instance court sentenced the lawyer to two years imprisonment and a five-year driving ban. However, in March this year the higher court reduced the sentence to 18 months and shortened the ban to four years.
Prosecutor Brodowski explained that although the case does not concern murder or acquittal, regulations allow for the possibility of cassation by the National Prosecutor. The application in this matter has already been submitted.
The convicted man did not report voluntarily to prison and evaded the justice system. Officers caught up with him on 7 May and placed him in custody in Hrubieszów. He was later transferred to West Pomerania, where another investigation is being conducted.
In his flat, together with his wife, they were storing illegal substances. During a search, almost 50 grammes of cannabis product were found. The couple were placed under police supervision and a ban on leaving the country. For these acts they face up to ten years behind bars.
During testing after the accident, minimal levels of cocaine were detected in Paweł K., but insufficient to bring charges. When questioned by investigators about where the drug came from in his system, the lawyer claimed he did not use it intentionally. He added that it could have entered his bloodstream through a glass from which he drank.
