Uruguayan courts upheld a decade-long sentence in closed custody for a minor who committed a murder with a firearm in the department of Canelones during the winter of 2023.
The young man, whose identity is withheld under the initial "B.", was 17 years old at the time of the attack. In Toledo, a town in the aforementioned department, he fired a shotgun at a 25-year-old man, causing his death. Another minor suffered injuries to one of their hands during the same incident.
The Public Ministry in the area had obtained the first-instance sentence in November. The ruling classified the facts as an extremely serious offence, typified as especially aggravated homicide in actual repetition with personal injury, according to information released by the General Prosecutor's Office.
The penalty imposed consisted of deprivation of liberty in a centre of the National Institute for Adolescent Social Inclusion for a period of ten years. This sentence represents the legal maximum applicable when the author of a crime of this nature is a minor.
Now, the Family Appeals Court of the first rotation fully ratified the resolution of the first-instance judge. The members of the panel rejected the arguments of the defence, which had attempted to justify the aggression by alleging supposed prior conflicts between the victim and the aggressor along with his close circle.
According to the second-instance ruling, that version lacks credibility, since it is based solely on the statements of the defendant himself, his mother and his sister, without any supporting evidence.
The magistrates further noted that there is a marked disproportion between the alleged reason that motivated the confrontation and the decision to take a life. When confirming the measure, they assessed the extreme gravity of the case, the damage to the most precious legal good—the victim's right to life—the absence of mitigating factors derived from genuine confession or true remorse, and the profile of the convicted person, described as having a complicated prognosis for the future.
