Cerimedo's Defence Announces Legal Resources to Prevent Transfer to Chonchocoro
Lawyer Ernesto Giraldes announced new legal actions to prevent Fernando Cerimedo's transfer to the La Paz prison, following the judicial rejection of the habeas corpus action.
Cerimedo's legal team seeks to halt transfer to La Paz prison
The defence of Fernando Cerimedo is preparing new legal actions to prevent his transfer to Chonchocoro prison in La Paz, after Justice rejected this Friday the habeas corpus action presented for that purpose, according to information from El Deber.
Lawyer Ernesto Giraldes acknowledged that the legal team in Santa Cruz had no prior knowledge of the habeas corpus action filed by Cerimedo's defenders in La Paz. Despite this, he confirmed that the team will continue seeking legal mechanisms to prevent the transfer. "We, the legal team, are working on preventing the transfer, but in a legal way by taking legal actions," he stated after the hearing.
Giraldes also pointed out that Cerimedo is emotionally affected by his situation and reiterated that the transfer could put his integrity at risk. "It will take time, but we will see, God willing, that transfer is not carried out," he said.
Two arrest orders in conflict
The defence's central argument revolves around the existence of two preventive detention orders issued in different proceedings. The first was issued on 21 August 2026 by a judge in Santa Cruz, within the investigation into the alleged attempted femicide against his ex-partner, Nadia Beller, and establishes detention in Palmasola. The second was issued on 29 August by a judge in La Paz, within an investigation into alleged money laundering with harm to the State, and sets 180 days of preventive detention in Chonchocoro.
Giraldes maintains that the older order must be complied with first. "There are two preventive detention orders and the one that was ordered first must be complied with, which is from 21 August 2026, not from 29 August," he stated. The lawyer acknowledged, however, that legislation does not clearly address how to proceed when two different courts issue detention orders for different penitentiary facilities. "These are two different proceedings, not even to connect them, to see that they are in just one," he explained.
Palmasola has not yet received formal transfer order
Although Justice upheld Cerimedo's detention in Chonchocoro, the transfer has not yet been carried out. The Palmasola administration reported that it had not yet received a formal order to take the former political adviser to La Paz. The notification must reach the penitentiary authorities so that the security operation can be organised and the judicial ruling can be executed.
Giraldes avoided revealing what the next resource the defence will submit. "For now we are not going to disclose the strategy, but we will continue working," he stated. Regarding alleged threats against Cerimedo, the lawyer declined to provide details and anticipated that the strategy would focus on challenging the legality of the detention and the manner in which the two judicial orders should be executed. "We will pursue the legality of the preventive detention," he emphasised.
Cerimedo remains in Palmasola
While new legal resources are being processed, Cerimedo remains detained in Palmasola, where he is serving the first preventive detention linked to the proceedings for the alleged attempted femicide against Nadia Beller. In parallel, the ruling from the La Paz Justice system maintains the order for 180 days in Chonchocoro in force. The defence seeks to have that measure suspended whilst it files resources so that, according to its interpretation, the first judicial order prevails and Cerimedo remains in Santa Cruz.
