Roberto Peixoto, former municipal administrator of Taubaté, will continue serving his sentence in the prison system. On Thursday (16), the São Paulo Court of Justice rejected a plea for him to return to supervised release.
The ruling was issued by judge Alexandre Coelho, who is overseeing the habeas corpus petition filed by the politician's legal team. The defenders argue that their client suffers severe consequences of a stroke, including neurological and motor impairment, which would make it impossible for him to serve his sentence in a prison facility.
Peixoto was placed in custody on Wednesday (15), when he was supposed to begin serving a 10-year and 6-month sentence imposed by the court in a money concealment case.
The rapporteur, however, found that there was no demonstration of such flagrant irregularity as to justify the immediate granting of the benefit. He added that, since custody had only recently begun and the request for clinical evaluation was still awaiting assessment by the judge of criminal execution, there are currently insufficient grounds to transfer the convict to his residence.
Peixoto's legal advisers informed authorities that he is ready to submit to medical inspection and requested priority scheduling. The contents of the mandamus will be considered later, following a statement from the Public Prosecutor's Office. According to his attorneys, an appeal has already been filed.
