The lawyers of the woman who admitted to killing her son in Gemona have challenged before the Court of Review in Trieste the decision of the preliminary investigation judge in Udine. The magistrate had rejected the request to transform prison detention into house arrest for the woman, an accomplice of her daughter-in-law in the killing of her son that occurred at home last July.
Lawyers Alice and Paolo Bevilacqua contest the reasoning of the order. According to them, the measure overlooks numerous favourable elements that emerged during the investigation: the admission of responsibility, the collaborative contribution to the investigation and the absence of any evasive behaviour. These factors, the defence lawyers argue, should have a decisive impact on the assessment of social danger.
The lawyers further point out that the contested decision indicates no current and concrete risk of reoffending, but rather limits itself to a prognosis formulated in a theoretical and speculative manner.
